Een Wet Openbaarheid van Bestuur (WOB) verzoek ACTA teksten vrij te geven is afgewezen door de regering. Ik tekende hier bezwaar tegen aan, hieronder de gronden van bezwaar.
1. Veel bepalingen in ACTA hebben een verplichtend karakter: "Each Party shall". Inhoudelijk betreffen deze (veelal) wetgeving, bijv "Each Party shall provide for criminal procedures and penalties to be applied at (...)". Er is een verplichtende relatie tussen ACTA en wetgeving.
2. ACTA creëert een op de Unie en lidstaten rustende verplichting tot wetgeving. Deze valt binnen de door het Hof van Justitie in de Turco zaak gebruikte formuleringen "basis of a legislative act" en "considerations underpinning legislative action".
3. Het Verdrag van Wenen over de Wet van Verdragen bepaalt dat de rechtsgeschiedenis van verdragen een rol speelt bij de interpretatie van verdragen. Zonder volledige openheid moeten parlementen over een verdrag stemmen waar niet alle aspecten van bekend zijn. Dit tast het democratische karakter van de Unie en de lidstaten aan. De geheimhouding is afgesproken zonder parlementen op de hoogte te brengen.
4. In Europa worden beslissingen zo open mogelijk genomen en zo dicht mogelijk bij de burger. De geheimhouding van ACTA schendt dit principe zonder noodzaak. De geheimhouding is onnodig, binnen de kaders van WTO en WIPO is er wel transparantie. De geheimhouding ondermijnt de democratie en is in strijd met het proportionaliteitsbeginsel.
5. De afspraak ACTA geheim te houden is illegaal en dient buiten beschouwing te blijven.
