Voor ondernemers is het weer eens wat anders, in plaats van blauwe enveloppen ontvangen ze een paarse enveloppe. "Analoge spam?" is de eerste gedachte. "Hmm, mijn bedrijfsnaam, t.a.v. Crediteurenadministratie, mijn adres, spookfactuur zeker?" Toch maar even openmaken. "Ah! Een plaagfactuur van onze vrienden van reprorecht." Dan volgt het dilemma van de gemiddelde drukke ondernemer: geen tijd om dit soort pesterijtjes aan te vechten en dus betalen we maar weer.

CETA's cross-border data flows will be provisionally applied
The EU Council website confirms that the EU-Canada trade agreement's (CETA) cross-border data flow commitments will be provisionally applied. In a letter to Dutch Parliament, Monday, Vrijschrift noted that CETA would undermine the protection of personal data. Vrijschrift also noted that the "commitments with respect to cross-border data flows would fall under provisional application of CETA. After ratification by the European Parliament, the Netherlands would face faits accomplis regarding data flows, a weak related safeguard, and the undermining of the protection of personal data."
The Council document shows that CETA's cross-border trade in services (articles 9.3 and 9.5), "which inevitably involves the processing and transferring of personal data in connection with the conduct of a service supplier's business", 1 will not be excluded from provisional application. The Netherlands and other member states would face the faits accomplis noted in the Vrijschrift letter. How to avoid this? Do not sign CETA.

Vrijschrift steunt manifestatie tegen "foute handelsverdragen"
Op 22 oktober organiseren maatschappelijke organisaties een manifestatie tegen handelsverdragen TTIP, TISA en CETA (in Amsterdam, 1 pm). Vorig jaar steunde Vrijschrift een dergelijke manifestatie en legde uitgebreid uit waarom. Sindsdien is deze kwestie urgenter geworden. Het verdrag met Canada (CETA) is klaar voor ratificatie, zie onze brief aan de Tweede Kamercommissie Buitenlandse Handel. De Trade in Services Agreement (TiSA) zou ook bijna klaar zijn, zie voor TiSA de EDRi website. Vrijschrift steunt ook dit jaar de manifestatie.

CETA will undermine protection of personal data
The EU trade agreement with Canada (CETA) would undermine the protection of personal data, the Vrijschrift Foundation writes in a letter to Dutch Parliament. On 18 October the EU Council of Ministers will take a decision on signing and provisional application of CETA. Provisional application of CETA would create faits accomplis (the Netherlands did not ratify the agreement with Ukraine, but the provisional application was not terminated). Het EU-handelsverdrag met Canada (CETA) ondermijnt de bescherming van persoonlijke gegevens, schrijft Stichting Vrijschrift in een brief aan de Tweede Kamercommissie Buitenlandse Handel en Ontwikkelingssamenwerking. Deze commissie vergadert over tekenen en voorlopige toepassing van het verdrag op 12 oktober. Door voorlopige toepassing zou Nederland voor voldongen feiten komen te staan. (pdf versie)

Zeer geachte heer De Roon,
Op 18 oktober zal de EU Raad van Ministers een beslissing nemen over ondertekenen en voorlopige toepassing van het handelsverdrag met Canada (CETA). In deze brief willen wij er onder andere op wijzen dat CETA de bescherming van persoonlijke gegevens zal ondermijnen.
Canada is lid van de "Five Eyes", een groep landen met vergaande afluisterpraktijken. De Canadese Communication Security Establishment mag buitenlanders afluisteren. 1 Veel internet verkeer met Canada loopt via de Verenigde Staten, doorgaans via steden met NSA afluisterfaciliteiten. 2
